News THE DEBT Recovery Tribunal (DRT-I) Chandigarh on Tuesday dismissed an application moved by Hotel Park Plaza owned by James Hotels Limited challenging the district magistrate’s August 3 orders for handing over its possession to a consortium of banks including the Punjab National Bank for company’s failure to repay around Rs 103 crore loan to the banks During the pendency of the case before the DRT-I the banks had on August 26 forcibly taken the possession of the hotel on the basis of the district magistrate’s order with the help of Chandigarh Police Hotel’s application dated August 23 was pending before the DRT-I in securitisation proceedings initiated by the lender banks But the DRT-I took serious note of the “undue haste” shown by the banks to take over possession of the hotel without waiting for the outcome of the case in the tribunal In its 14-page order the presiding officer said “Bank officers may have got pat from their seniors for their act but have attained shame for such hasty action which is not appreciable to the society for which the bank should take appropriate action against the concerned officers who are seen in the photographs and higher police officers too as they have no right to touch the secured assets which ultimately remain a part of the inventory” The bench observed from the photographs placed on record that the police officers deputed to control law and order also became part of the vandalism The total outstanding loan amount against James Hotels Limited is around Rs 103 crore out of which Rs 58 crore it has to pay to Asset Reconstruction Company India Ltd (ARCIL) Rs 3349 crore to Punjab National Bank (PNB) and Rs 1161 crore to United Bank of India (UBI) Pointing out the “pick and choose policy” of the banks the presiding officer said “In fact this pick and choose policy is writ large and the observations of the court are not hypothetical as today itself before pronouncing the order in another case of the same bank against another three star hotel in which defaulters to the tune of 100 crores of rupees where property too is running hotel have not been touched after taking permission from the DM and having no stay by the court” The DRT bench noted “It is the morality which has become shameful that the authorised officer and the officers of the police department have scandalised with the help of third parties whom the applicants (hotel) have termed political bosses of particular political parties who invaded the premises along with police and without showing any respect to the ladies staff even and took possession of the property of administrative blocks and personal rooms decoding the security systems putting at risk the right to privacy” The presiding officer remarked “The bank may try to show action under the provision of the law but it is greedy hand in glove officers who were responsible for creating such an atmosphere which even otherwise could be avoided once the matter was already before the court to be taken care of” The DRT-I has now adjourned the case for September 7 However the case will now come up for hearing in the High Court on Wednesday For all the latest
